Public charter schools have been established by the state of Oregon to provide an opportunity to create new, innovative and flexible ways of educating students within the public school system. The Northwest Regional Education Service District (NWRESD) therefore finds that providing services to public charter schools will further its mission as an education service district to assist component school districts and the Oregon Department of Education to ensure an equitable and excellent education for all children in the state. The NWRESD further finds that assisting its component school districts with establishment or review of public charter schools is consistent with this mission. Provision of such services will be governed by the following: 

1. A public charter school may receive resolution services approved under Oregon Revised Statute (ORS) 334.175 from the NWRESD in the same manner as a non-chartered public school in the district in which the public charter school is located. 

2. The NWRESD may elect to provide services other than those described in subsection 1 of this Policy by contract with a public charter school. The NWRESD Board will be notified of such contracts.  Such contracts will be in substantially the same form as intergovernmental agreements for services with the NWRESD’s component school districts. The NWRESD will not approve a contract with a public charter school prior to seeking the input and consent of the component school district in which the public charter school is located. 

3. The NWRESD may contractually provide the services of NWRESD employees to a public charter school. NWRESD employees whose services are provided under such a contract will remain at all times under the direction and control of the NWRESD. 

4. The NWRESD may contractually provide such other services to public charter schools as it deems prudent and in the best interests of students in the NWRESD. Under no circumstances will the NWRESD assume any part of the direct administration or management of a public charter school, but may contractually assist a public charter school in the performance of its duties. In addition, the NWRESD will not agree to administer or be legally responsible for funds allocated to a public charter school by a component school district, the Oregon Department of Education, or the federal government. 

5. The NWRESD may by intergovernmental agreement assist in the establishment and operation of a public charter school by a component school district. Provision of such services shall be subject to the conditions and limitations set forth in subsections 2 through 4 of this Policy. 

6. The NWRESD may by intergovernmental agreement assist a component school district with the review and approval of applications for a public charter school. The NWRESD will not contractually assume any of the duties or responsibilities imposed upon a sponsoring school district by the Oregon Public Charter School law, but may contractually assist a component school district in the performance of its duties as sponsor. 

7. The NWRESD may not sponsor a public charter school. 

8. All payments received by the NWRESD for services performed pursuant to this Policy shall be provided for in the contract with the charter school or with the component school district. 

9. To the extent such information is reasonably available, the NWRESD will make available to the public lists of vacant and unused public and private buildings or portions of buildings that may be suitable for the operation of a public charter school.
