The Board shall declare the office of a Board member vacant upon any of the following when the incumbent:
1. Dies or resigns;
2. Ceases to be a resident of a school district that is located within the territory of the Northwest Regional Education Service District (NWRESD);
3. Ceases to discharge the duties of office for two consecutive months unless prevented by sickness or unavoidable cause;
4. Is removed from office or a court declares the election for the office void;
5. Has been recalled from office by district voters; or
6. Is elected by zone and moves from the zone to which he/she was elected. When the incumbent has been nominated from a zone and changes permanent residence from one zone to another zone in which another director resides, the incumbent shall continue to serve as director until the next regular election when a successor shall be elected to serve for the remainder of the unexpired term.
A director guilty of misfeasance or malfeasance in office, by appropriate proceeding, may be removed from office by a court of competent jurisdiction.
The Board may not declare the office of a director vacant if the director is a resident of a school district that withdraws from the education service district, unless the director’s term expires or the Board declares the office vacant for a reason described in items 1 through 6 above.
Any vacancy on the Board of an elected member from any numbered zone position shall be filled through election by the component school district boards from within that zone from among qualified members in that numbered position’s zone. Any vacancy on the Board of an appointed member from any position designated by letter shall be filled by the remaining members of the Board from among persons qualified for that position. The term of office of the person appointed or elected to fill a board vacancy will be the time remaining in the vacated Board position.
